This Privacy Statement applies when you:

NV Vesta Group and/or its affiliated companies declare to only collect and process data that are relevant or necessary for the purposes for which they are processed. Depending on these purposes, NV Vesta Group and/or its affiliated companies process the following categories of personal data (non-exhaustive):

NV Vesta Group may use data processors for the proper performance of its services to you. A processor may, at the request or instruction of or on behalf of NV Vesta Group, process your personal data, whereby the processor shall be obliged to ensure the security and confidentiality of the personal data.

8. Your rights under this Privacy Statement

8.1.  Right to information

With this Privacy Statement, NV Vesta Group wishes to inform you as fully as possible about the processing of your personal data. Your data will be processed for legitimate purposes in an appropriate, relevant, secure and proportionate manner. They will not be kept for longer than necessary and always with the utmost integrity and confidentiality.

8.2.  Right of access

You always have the right to verify the lawfulness of any processing of your personal data and to request NV Vesta Group to provide you with information regarding the purposes of the processing, the categories of your personal data, the categories of recipients of your personal data, the retention period and the rights you can exercise.

You also have the right to ask NV Vesta Group for a copy of the personal data processed about you. This copy will in principle be provided to you free of charge unless your request would be unreasonable or excessive. In such case, an administrative fee may be charged by NV Vesta Group.

8.3.  Right of rectification

You have the right to correct inaccurate data or complete incomplete data upon simple request to NV Vesta Group.

8.4.  Right to data erasure

You have the right to request NV Vesta Group to delete your personal data if there is no longer a legitimate reason for NV Vesta Group to continue processing it. You may exercise this right in the following cases:

• Your personal data are no longer necessary to fulfil the purpose pursued;
• You prove that NV Vesta Group has unlawfully processed your data;
• Your personal data should be deleted pursuant to a legal obligation;
• You revoke your consent to the processing of your personal data and there is no other legal basis for processing your data;
• You have successfully exercised your right to object (see section 8.6).

However, NV Vesta Group retains the right to refuse your request for deletion with reasons, and cannot be held liable for the fact that deleted personal data remains temporarily stored somewhere, invisible to it.

8.5.  Right to restriction of data processing

You have the right to demand the restriction of data processing in any of the following circumstances:

• You dispute the accuracy of the personal data processed by NV Vesta Group and NV Vesta Group has been given a reasonable time to verify the accuracy of the personal data;
• You prove that the processing by NV Vesta Group was unlawful and request a restriction;
• You exercise your right to object (see section 8.6).
   

8.6.  Right to object to data processing

You have the right to object at any time to the processing of your personal data for 'direct marketing' purposes. NV Vesta Group will cease processing your personal data.

9. Exercise of your rights

If you wish to exercise your rights, you should send a written request and proof of identity to NV Vesta Group through one of the following channels:

10. How to complain?

If you have certain complaints about the processing of your personal data, we thank you to first contact us directly about this via one of the contact channels described in article 8 so that we can resolve it for you.

Furthermore, you also always have the right to lodge a complaint with the competent Data Protection Authority via the website of the Data Protection Authority.

11.  Stay informed about changes

NV Vesta Group is entitled to improve or amend this Privacy Statement at any time, whereby the amendments will apply immediately upon their publication on its website. You should (re)view this Privacy Statement at regular intervals to ensure yourself of the amendments. The continuation of your contractual relationship or use of our website or services will be considered as acceptance of any changes made to this Privacy Statement.

12. Applicable law and jurisdiction

This Privacy Statement is subject to the laws and regulations applicable in Belgium and only the courts of the judicial district of KORTRIJK have jurisdiction in case of dispute.
