GENERAL TERMS AND CONDITIONS
Article 1. Identity of the seller
1.1 Nomads is a trademark of Desmyttere Marketingadvies bv, with registered office in Belgium, 9831 Deurle, Antoon de Pesseroeylaan 24. We can be reached via e-mail info@nomadsroadtrips.com. Our company number is BE 0887.356.592, our bank account number is BE22 0019 2361 1747.
Article 2. Applicability & Conditions
2.1 These general terms and conditions apply to every road trip purchased through our website and apply to every natural person who acquires or uses one or more products.
2.2 A purchase on our website is not bound to any specific region. Given the purely online nature of our services and products, no shipping costs are applicable.
2.3 In order to place an order, you must be at least 18 years old. If you are not 18, we ask that you have your parents or legal guardian place the order. If we become aware that an order has been placed by a minor, we may refuse it.
2.4 Placing an order through the Website constitutes express acceptance of our terms and conditions of sale which are available on the website.
2.5 If you order online you will receive a confirmation email and a link to our terms and conditions.
Article 3: Our offer
3.1 We make every effort to describe as completely and accurately as possible what we are selling you and how the ordering process works. This description is sufficiently detailed for you to make a proper assessment. If we use pictures, they are a true representation of the goods and/or services offered.
3.2 Your order is complete and the agreement between us is final as soon as the payment transaction via our payment provider Mollie has been successfully completed and the download is available. We provide payments via Visa, MasterCard, Maestro, Bancontact, iDeal, Klarna, GiroPay and ApplePay. If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without a valid payment in the name of the registered cardholder will not be accepted or processed.
3.3 Are you unable to complete an online payment process? Then you can also pay the cost of one or more chosen road trips by bank transfer to the above-mentioned account number (see article 1 of these terms and conditions of sale). Upon receipt of your payment, we will e-mail you the link to the web page where you will find the download of the roadtrip.
3.4 You do not need to create an account on our website to purchase a product. It suffices to click on the payment link or to scan the QR code which you find on every product page.
Article 4: Right of withdrawal and complaints
4.1 Due to the online nature of our products (PDF download, gpx and/or kmz file), the customer cannot invoke a right of return. You cannot therefore renounce your purchase.
4.2 We naturally hope that all our customers are 100% satisfied. However, if you have any complaints about our services, please contact us at info@nomadsroadtrips.com. We will do everything we can to deal with your complaint within 7 days.
4.3 All agreements that we make with our customers, regardless of their place of residence, are governed by Belgian law and in the event of a dispute only the competent Belgian courts are competent. If, for reasons of international law, another law is applicable, the interpretation of these general terms and conditions will be based, in the first place, on Book VI of the Belgian Economic Code.
4.4 In the event of a non-judicial settlement of the dispute, the Consumers' Ombudsman Service of the Federal Government is authorised to receive any request for non-judicial settlement of consumer disputes. The latter will in turn either deal with the application itself or forward it to a qualified entity. 4.5 In the event of cross-border disputes, you can also use the Online Dispute Resolution platform of the European Union via this link: http://ec.europa.eu/odr.
Article 5: Price and payment
5.1 Our prices include all taxes, VAT, duties and services. You will therefore never be faced with surprises.
5.2 We accept payment via the payment module on our website as well as by bank transfer to our account.
5.3 Our payment provider Mollie (www.mollie.com) guarantees secure online payment and the safety of your personal data, as transaction data is sent over the internet encrypted using SSL technology. You do not need any special software to pay with SSL. You can recognise a secure SSL connection by the "lock" in the lower status bar of your browser.
Article 6: Force majeure
6.1 In the event of force majeure, we shall not be obliged to fulfil our obligations. Force majeure is any circumstance outside our will and control that prevents us from fulfilling our obligations in whole or in part. We understand these circumstances to include strikes, fire, business interruptions, energy interruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of our website at any time, non-delivery or late delivery by suppliers or other third parties used, etc.
Article 7: Intellectual property
7.1 Our website, logos, texts, images and in general all our communications are protected by intellectual property rights that lie either with us, our suppliers or other right holders.
7.2. It is prohibited to make use of and/or change the intellectual property rights as described in this article. For example, you may not copy or reproduce images, texts, logos, etc ... without our prior and express written consent.
7.3 It is strictly forbidden for the buyer to offer our digital products for payment on his own or external website.
