Article 1 - Notification of general terms and conditions :
In the event of an agreement/quote/order/order confirmation, the customer expressly declares that he has taken note of the general terms and conditions of sale and that he accepts their contents in full and without reservation, even if they conflict with his own general terms and conditions.
Therefore, only the general terms and conditions of Lumotronic apply to all agreements/quotations/orders/order confirmations between Lumotronic and the customer.
Lumotronic reserves the right to change the general terms and conditions of sale at any time without personally informing the customer.
On current contracts, however, the conditions that were applicable at the time of the conclusion of the sale always apply.
It is up to the customer to regularly check our sales conditions for changes.
The customer can therefore under no circumstances claim any form of compensation.
Article 2 - Prices :
The prices stated in the price list(s) or on the web shop are valid at the time of order.
Lumotronic reserves the right to change its offer and price lists at any time.
Lumotronic can refuse orders if the price or specifications of the item would be incorrect in the event of human, technical error or force majeure.
If the customer wishes to make changes after his current order, these changes will only be made if Lumotronic expressly agrees to this and the customer accepts that all price adjustments/costs that the changes entail will be invoiced to him in full.
Article 3 - Payment and invoicing :
Our invoices are payable in cash, without discount and on the due date indicated on our invoice.
Lumotronic is permitted to make partial deliveries and to invoice these separately to the customer, unless otherwise agreed in writing.
Invoices not paid on the specified due date are automatically and without a reminder being required, increased with an interest of 2% per month and this from the invoice date.
In the absence of payment on the due date, the customer is also obliged to pay compensation for non-payment, equal to 10% of the invoice amount, irrespective of the interest payment above.
Failure to pay on the due date of a single invoice makes the balance due on all other invoices, even those that are not due, immediately due and payable by operation of law.
Lumotronic reserves the right of ownership to all goods, as well as the right not to deliver or cancel outstanding orders as long as the customer has not fully fulfilled all his obligations towards the seller.
In the event that the customer processes or resells the goods belonging to us himself, he assigns to us all claims arising from this sale by way of pledge.
In the event of a dispute, only the courts of the district of Tongeren are competent.
For online orders, Lumotronic works together with Mollie payment system:
- Bancontact / Mister Cash
- Bank transfer (in this case the products ordered by you will only be reserved after receipt of your payment).
- Credit card
- iDEAL
- Sofort Banking
Online orders are only sent after receipt of payment.
Article 4 - Delivery and shipping costs :
All goods are shipped at the customer's risk.
If the goods are damaged upon receipt, the customer must contact Lumotronic within 24 hours.
Delays in deliveries can in no way give rise to cancellation of the order or claim for damages.
Shipping costs for deliveries within the Benelux:
- Order amount above €300 excluding VAT, the shipping costs are free, unless otherwise stated in writing.
- Order amount below 300€ excluding VAT - package with a weight up to 32 kg (maximum dimensions 200x80x60cm): standard 15€ shipping costs will be charged, unless otherwise
stated in writing.
- For delivery of 2.5 and 3 meter profiles, a shipping cost of €37 (Belgium) and 47€ (The Netherlands) is always charged, regardless of the order quantity.
- Express deliveries are always at the customer's expense.
Shipping costs for deliveries outside the Benelux:
- Different rates apply here, these are stated on the quotation/order confirmation or when paying in the webshop.
Article 5 - Delivery times :
The specified delivery times are provided for information purposes only and are therefore in no way binding. Exceeding this delivery term does not entitle the customer to any compensation for any direct or indirect damage suffered by him or by third parties, or cancellation of the order, or change of payment conditions.
Article 6 - Ownership :
Lumotronic remains the owner of the sold and delivered goods as long as payment for the goods has not been received in full. Any interest and compensation included.
Article 7 - Right of withdrawal :
If it appears that the items were ordered incorrectly by the customer, they will only be taken back if this concerns standard stock items.
Customization or items specially ordered at the request of the customer can under no circumstances be returned.
Incorrectly ordered standard items must be returned within fourteen (14) days after delivery.
The costs and responsibility for returning incorrectly ordered items to Lumotronic located at Prinsenweg 9 bus 7 in 3700 Tongeren is for the account of the customer.
Reimbursement of incorrectly ordered items only concerns the price of the ordered goods -10%, the shipping costs to deliver the order are not refunded.

After the expiry of the stated term, the customer is deemed to have accepted the delivered items and the related invoice.
Only undamaged, unused standard items in the original packaging can be returned.
Article 8 - Complaints :
Any complaint must be submitted in writing and at the latest 8 days after receipt of the goods.
After this period, the order will be deemed to have been approved. A submitted complaint does not suspend the customer's payment obligation, Lumotronic has the right to investigate the complaint.
We use a "carry-in" manufacturer's warranty, which means that the customer must return the defective goods at his own expense. Defects are only accepted back if they are accompanied by an RMA number. Lumotronic can never be held responsible for installation and/or other costs resulting from any repairs or replacements or of any kind.
Article 9 - Samples:
The provision of samples, models, examples, etc... always takes place by way of "indication". The qualities of the goods to be delivered may deviate from this. All samples that are sent will be invoiced first and credited when they are returned in their original condition and packaging within the term.
The shipping costs are always borne by the customer and will not be credited.
Article 10 - Warranty :
The warranty period is standard 2 years on the lighting devices and drivers unless otherwise agreed in writing.
No warranty applies to batteries.
Warranty expires in the event of: damage/defects as a result of incorrect use, article no longer in its original condition, water damage, oxidation, fall, wear, poor maintenance or used in violation of the manufacturer's instructions.
Article 11 - Privacy :
We treat your data as confidential information and will never pass it on to third parties.
You can request, correct, change or delete your data that Lumotronic stores at any time.
You can submit any request, change or deletion to sales@lumotronic.eu or in writing to Lumotronic - Prinsenweg 9 box 7 - 3700 Tongeren.

Article 12 - Applicable Law :
In the event of a dispute regarding the validity, interpretation or execution of the agreement, only the courts of the district of Tongeren where the seller's registered office is located are competent.
Belgian law applies exclusively to all agreements that we conclude with our customers, regardless of their place of residence.
